Pakistan: Electronic Data Protection Act 2005 (Final Draft)

Pakistan Software Export Board (PSEB), a government entity has drafted “Electronic Data Protection Act 2005” by outsourcing the work to an individual Mr. Aslam Hayat Khan. As per PSEB, the proposed Act aims to prevent unauthorized access and theft of electronic data and to ensure intellectual property rights with regards to the processing of electronic data in Pakistan.

We have received an email through PSEB’s mailing list on 19th April, 2006 seeking feedback/comments on the draft act by the deadline of April 26, 2006. It is again that weird kind of consultation process, by putting the draft act on website and they think that everybody will know about it and will send comments to an email address.

Well, before engaging with PSEB on this, thought that we should seek your expert opinion. Anyone who has prior knowledge and experience on this kind of legislation may like to help us identify gaps if any.

We will then make sure to deliver these observations to PSEB and Ministry of IT, Government of Pakistan.
